TERMS OF SERVICE

Next Edge Academy

1. ACCEPTANCE OF TERMS

By enrolling in classes, using our facilities, or participating in any programs at Next Edge Academy ("Academy," "we," "our," or "us"), you ("Member," "you," or "your") agree to be bound by these Terms of Service and all applicable laws and regulations.

2. PROGRAMS AND SERVICES

Available Programs:

• Brazilian Jiu-Jitsu (BJJ): Adults, teens, and kids classes
• Boxing: Adults and teens
• Kickboxing/Muay Thai: Adults and teens
• Mixed Martial Arts (MMA): Adults and teens
• Women's Self-Defense: Sundays at 1:00 PM
• Competition Teams: Boxing, Muay Thai, BJJ, and MMA

Class Policies:

• Members may participate in multiple programs for the same membership fee
• Class schedules are subject to change with reasonable notice
• Make-up classes can be attended at any regularly scheduled class
• Beginner programs require completion before advancing to mixed-skill classes

3. MEMBERSHIP AND PRICING

Payment Terms:

• Payment options: Bi-weekly, monthly, quarterly, semi-annually, or annually
• No late fees are charged; flexible payment timing is available
• Annual memberships receive priority scheduling and discounted rates
• All fees are non-refundable except as required by law

4. ASSUMPTION OF RISK AND WAIVER

By participating in our programs, you acknowledge and assume all risks associated with martial arts training. You voluntarily participate with full knowledge of these risks.

5. RELEASE AND INDEMNIFICATION

You hereby release, waive, discharge, and covenant not to sue Next Edge Academy, its owners, instructors, employees, and agents from any and all liability, claims, demands, or causes of action arising from your participation in our programs, except for gross negligence or willful misconduct.

6. FACILITY RULES AND CONDUCT

General Rules:

• Respectful behavior toward all members, staff, and instructors is required
• Proper training attire must be worn (gis, athletic wear, protective equipment)
• Personal hygiene standards must be maintained
• No shoes on training mats
• Follow all instructor directions and safety protocols
• No unsupervised use of equipment

Prohibited Conduct:

• Aggressive or violent behavior outside of supervised training
• Use of alcohol or illegal substances on premises
• Theft or damage to Academy property
• Harassment or discrimination of any kind
• Recording or photography without permission

7. HEALTH AND MEDICAL REQUIREMENTS

• Members must be in adequate physical condition to participate
• Disclosure of relevant medical conditions is required
• Members train at their own risk and should consult physicians before beginning
• Academy staff are not medical professionals and cannot provide medical advice
• Members must have current health insurance coverage

8. MINORS

• Parent/guardian consent is required for all participants under 18
• Parents/guardians assume all responsibility and liability for minor participants
• Minors must be supervised by Academy staff during all activities
• Age-appropriate programs and supervision are provided

9. EQUIPMENT AND MERCHANDISE

Personal Equipment:

• Members are responsible for their own protective gear and training equipment
• Academy is not responsible for lost, stolen, or damaged personal items
• Proper protective equipment is required for sparring and competition training

Academy Merchandise:

• Gis, gloves, protective gear, and apparel available for purchase
• All sales are final unless merchandise is defective
• Prices subject to change without notice

10. CANCELLATION AND TERMINATION

Member Cancellation:

• 30-day written notice required for membership cancellation
• Annual memberships cannot be cancelled except for medical reasons with physician documentation
• No refunds for unused portions of membership fees

Academy Termination Rights:

• Academy reserves the right to terminate memberships for rule violations
• Non-payment may result in suspension of privileges
• Termination for cause does not entitle member to refund

11. INTELLECTUAL PROPERTY

• All training materials, techniques, and curricula are proprietary to Next Edge Academy
• Members may not record, reproduce, or distribute Academy training content
• Academy name and logos are protected trademarks

12. PRIVACY AND MEDIA CONSENT

• Academy may photograph or video record classes for promotional purposes
• Members consent to use of their likeness in Academy marketing materials
• Personal information is protected according to our Privacy Policy
• Members may opt out of promotional photography by written request

13. COMPETITION TEAM

• Competition team participation requires additional commitment and training
• Competition team members must maintain regular attendance
• Competition fees and travel expenses are separate from membership fees
• Academy is not responsible for competition-related injuries or expenses

14. FORCE MAJEURE

Academy is not liable for inability to provide services due to circumstances beyond our control, including but not limited to natural disasters, government regulations, pandemics, or facility emergencies.

15. LIMITATION OF LIABILITY

Academy's total liability for any claims shall not exceed the amount of membership fees paid by the member in the 12 months preceding the incident giving rise to the claim.

16. GOVERNING LAW

These Terms of Service are governed by the laws of the State of South Dakota. Any disputes shall be resolved in the courts of Minnehaha County, South Dakota.

17. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

18. MODIFICATIONS

Academy reserves the right to modify these Terms of Service at any time. Members will be notified of significant changes via:

• Posted notice at the facility
• Email notification to active members
• Updated terms available upon request

19. ENTIRE AGREEMENT

These Terms of Service, together with the membership agreement and waiver, constitute the entire agreement between the member and Next Edge Academy.

By signing the membership agreement or participating in Academy programs, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
